1. Acceptance of Terms
By downloading or using StillHere ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Description of Service
StillHere is a check-in safety app that monitors daily check-ins and sends alerts to a designated emergency contact if a check-in is missed. The App is intended as a supplemental safety measure for people living alone.
3. Not an Emergency Service
🚨 StillHere is not an emergency response service. We do not contact emergency services (police, ambulance, fire) on your behalf. In any life-threatening situation, contact your local emergency services immediately. StillHere is a personal safety companion that notifies the emergency contact you designate.
4. Eligibility
You must be at least 13 years old to use StillHere. By using the App, you confirm you meet this requirement.
5. Payment & Refunds
- StillHere offers one free check-in. Full access requires a one-time payment of $2.99 USD.
- Payment is processed by Apple App Store or Google Play Store.
- All purchases are final. Refunds are handled according to Apple's or Google's refund policies.
- The one-time fee grants lifetime access to all current features.
6. Your Responsibilities
- You are responsible for providing accurate emergency contact information.
- You must obtain consent from your emergency contact before adding them to the App.
- You are responsible for ensuring your device has an active internet connection for the App to function.
- You must keep the App installed and notifications enabled for it to work correctly.
- You must not use the App for any unlawful purpose.
7. Emergency Contact Consent
By adding an emergency contact, you confirm that you have informed them that they may receive alert messages from StillHere on your behalf, and that they consent to receiving such messages including your location information.
8. Limitation of Liability
To the maximum extent permitted by law, StillHere and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Failure to deliver alerts due to network outages, device issues, or third-party service failures
- Inaccurate location data
- Delays in alert delivery
- Any harm resulting from reliance on the App as a sole safety measure
The App is provided "as is" without warranties of any kind. Your use of the App is at your own risk.
9. Service Availability
We strive to maintain 99% uptime but cannot guarantee uninterrupted service. We are not liable for downtime caused by maintenance, technical issues, or third-party service outages (Twilio, Supabase, etc.).
10. Termination
You may stop using the App at any time by deleting it. We reserve the right to terminate or suspend access to the App for violations of these terms.
11. Changes to Terms
We may update these terms from time to time. Continued use of the App after changes constitutes acceptance of the updated terms. We will notify users of material changes via the App.
12. Governing Law
These terms are governed by applicable law. Any disputes shall be resolved through binding arbitration where permitted by law.
